1. Can I have an estate sale or yard sale while my listing is in a Coming Soon or Hold status?
Showings are not allowed when a listing is in Coming Soon or Hold status. Estate sales and yard sales should only take place when the listing is Active. This is to ensure that people visiting the property during these sales do not inadvertently violate the no showings guidelines set for these statuses.
2. If I post a photo of a house or mention the neighborhood on my social media page, with the caption “Coming Soon”, is that a violation?
When you post a photo, a "Coming Soon" caption, mention the neighborhood, or any other marketing details, it's all part of promoting your listing. Even if you don't include the address, this still falls under Public Marketing due to the other existing marketing elements. Under the Clear Cooperation Policy, a new listing would then be required to be entered in the MLS within one calendar day of the post going live.
Just to clarify, there's absolutely nothing wrong with marketing your property this way. The only time it becomes a violation is when a property isn't submitted to the MLS within one calendar day from the start of public marketing, which is the date of a social media post. It's also important to note that if the Seller promotes the property on social media, that also counts as the beginning of public marketing, which means the listing should be submitted to the MLS within one calendar day from the start of marketing.
3. Is it necessary to update the status of my listing if I have not received the Due Diligence funds?
According to TMLS Rules and Regulations, all status changes should be made in the MLS within two business days from the effective date of the change. MLS does not consider Due Diligence as a caveat for status changes.
