Welcome to the Triangle MLS, Inc. d/b/a Doorify MLS (“DMLS”) website. This website and any services available on this website (the “Services”) are governed by the below terms and conditions, which are legally binding (together with the Privacy Policy, the DMCA Notice, and the Accessibility Policy, are called the "Terms"). Please read these Terms carefully.

BY ACCESSING THE SERVICES, YOU INDICATE YOUR AGREEMENT TO BE BOUND BY THE TERMS IN FULL, ALL APPLICABLE LAWS AND REGULATIONS, AND AGREE THAT YOU ARE RESPONSIBLE FOR COMPLIANCE WITH ANY APPLICABLE LAWS. IF YOU DO NOT AGREE WITH ANY OF THE TERMS, YOU ARE PROHIBITED FROM USING OR ACCESSING THE SERVICES. Users of the Services must be at least 18 years old; access or use by anyone younger is not authorized.
DMLS may modify these Terms from time to time by displaying the updated Terms on the Services. Please check this page regularly to ensure you are familiar with the current version of Terms. Your continued use of the Services after the updated Terms are displayed indicates your agreement to the modified Terms.
Use License
- Unless otherwise stated, DMLS, and its licensors, own all the intellectual property rights in the Services and material on the Services. Subject to the license described herein, all these intellectual property rights are reserved.
- You may view, download for caching purposes only, and print pages from the Services, subject to the restrictions set out below and elsewhere in the Terms.
- This is the grant of a license, not a transfer of title, and under this license you must not: (i) modify, copy, or republish the materials from the Services; (ii) sell, rent, or sublicense materials from the Services; (iii) attempt to decompile or reverse engineer any software contained in the Services; (iv) remove any copyright or other proprietary notations from the materials; or (v) transfer the materials to another person or "mirror" the materials on any other server.
- This license shall automatically terminate if you violate any of these restrictions and may be terminated by DMLS at any time for any reason. Upon termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
- No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties
- Prohibited Conduct
You expressly agree that you will not use the Services or send any email or other electronic communication containing a link to the Services:
- for any unlawful purpose, including posting, storing, sending, or otherwise transmitting information, data or material that is libelous, obscene, threatening, harassing or defamatory or which infringes the intellectual property rights of any person or which in any way encourages conduct that would be unlawful or inappropriate;
- in connection with any unsolicited bulk or commercial messages (commonly known as "spam"), any advertising or other form of communication that violates these Terms or any law or regulation, or in any manner that would disrupt in any way any internet site or Services;
- to initiate or perpetuate any illegal scheme (such as a pyramid scheme);
- to harvest (or engage in any type of systematic retrieval of) e-mail addresses or other identifiers or information or collect e-mail addresses;
- to impersonate any person or entity, falsify any sender address, forge anyone’s identity or perform any other fraudulent activity (such as "phishing");
- to conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the Services;
- use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
- to interfere with, or attempt to interfere with, any person’s ability to use the Services;
- to transmit or otherwise make available through the Services any computer code, file, program or other element (including any virus, worm, or other harmful malware of any nature) that would interrupt, destroy, interfere with or otherwise cause any other effect that might reasonably be considered undesirable;
- to attempt to (or actually) circumvent the security of, or any means to control access to, the Services;
- to frame the content of the Services (this includes the use of metatags or any other "hidden text" that incorporates DMLS Trademarks or marks confusingly similar to DMLS Trademarks).
DMLS Content
- You acknowledge that all rights, title and interest in all information and content on or provided through the Services, including, but not limited to property data, photographs, videos, and all media, software, screen display formats, design elements, texts, user names, passwords, web pages, or other materials, whether tangible or intangible (collectively “DMLS Content”), is the exclusive property of DMLS and its licensors and is protected by copyrights, trademarks or service marks and other intellectual property rights. These rights are owned and controlled by DMLS or by third parties that have licensed their content for display on the Services or the right to market and sell their products to DMLS. You are only permitted to use the DMLS Content as part of the Services and in accordance with these Terms. You agree to abide by all additional copyright notices or restrictions contained in or with any DMLS Content. Except as provided through the Services, DMLS Content may not be copied, reproduced, republished, uploaded, posted, transmitted, distributed or exploited in any way, without proper permission from DMLS or the content’s owner.
- If you believe any information or content on the Services infringes on your copyright, please see our Digital Millennium Copyright Act (DMCA) Notice linked here.
- "DMLS", “Doorify”, “Doorify MLS”, “Triangle MLS” and other names, trademarks, service marks, and indicia of source ("DMLS Trademarks") are owned by DMLS. Third party trademarks and tradenames that appear on the Services are owned by DMLS’s licensors. You may not use the DMLS Trademarks in connection with any products or services that do not belong to DMLS or in any manner likely to cause confusion about the source of any product or service, that implies that DMLS endorses anyone else’s product or service, or that disparages or discredits DMLS.
- The materials appearing on the Services could include technical, typographical, or photographic errors. DMLS does not warrant that any of the materials on its Services are accurate, complete, or current. DMLS may make changes to Services materials at any time without notice, however, DMLS does not commit to updating the materials.
- Content You Provide or Create on the Services
Regarding any information that you submit to or through the Services and any information or data that is generated by the Services that you create, transmit or display while using the Services (“User Content”):
- you will ensure that the User Content is accurate, current and complete;
- you are solely responsible for the content and accuracy of the User Content, and DMLS has no responsibility to you or to any third party for it;
- you agree to grant, and you hereby grant, to DMLS a world-wide, royalty-free, perpetual license (including the right to sublicense through multiple tiers) to exercise all rights in the User Content available to you under applicable law;
- DMLS may associate your identity on the Services (user name, real name, or both) with any User Content appearing to other users of the Services;
- DMLS may monitor, use, display, distribute, reproduce, publish and modify any User Content or other information you opt to post to publicly and privately accessible areas of the Services;
- DMLS may, but is not obliged to, edit, delete or move User Content that it deems Prohibited Content or otherwise unacceptable to DMLS in its sole discretion.
Passwords and Security
If you are a registered user, you are responsible for maintaining the confidentiality of your password(s) and account information on the Services, and you are fully responsible for all activities that occur under your password(s) or account(s). You agree to immediately notify DMLS of any unauthorized use of your password(s) or account(s) or any other breach of security.
Links to Third-Party Web Services, Content, Advertisement
The Services may contain links to web sites controlled by third parties, content generated or provided by a third party, or advertisement by or for a third party ("Third-Party Services"). DMLS is not responsible for Third-Party Services or their content, activities, or privacy practices, and provides such Third-Party Services merely as a convenience to you. Any information you share or actions you take on Third-Party Services are governed by those sites’ terms of use and privacy statements, which you should review carefully to learn about their practices. Including links on our Services does not imply our endorsement of Third-Party Services, their content, or any associated organization or activity. We make no representation or warranty whatsoever about the nature of Third-Party Services. Further, DMLS is not responsible for any loss or damages incurred by you on any Third-Party Services. Inclusion of Third-Party Services does not indicate DMLS endorsement or approval of the third party information, content, products, or services.
- Subscriber Agreements
If you are a participant or subscriber of DMLS, the provisions of these Terms are cumulative with those set out in participant subscriber, user or other agreement with DMLS (collectively, a “Subscriber Agreement”) to the extent that they are not inconsistent with each other; in the event the terms are inconsistent, the terms of the Subscriber Agreement shall prevail.
No Warranties
THE SERVICES ARE AVAILABLE "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED UNDER LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (EVEN IF THAT PURPOSE HAS BEEN DISCLOSED) AND ANY WARRANTY THAT THE SERVICES (1) WILL BE UNINTERRUPTED, FREE FROM ERRORS, OR FREE FROM VIRUSES, WORMS, "TROJAN HORSES" OR OTHER MALICIOUS CODE OR HARMFUL FEATURES OR (2) WILL MEET YOUR REQUIREMENTS OR BE ACCURATE, COMPLETE, TIMELY, RELIABLE, OR NON-INFRINGING. FURTHER, DMLS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON THE SERVICES OR OTHERWISE RELATING TO SUCH MATERIALS OR ON ANY SITES LINKED TO THIS SITE. WE RESERVE THE RIGHT TO CORRECT ANY ERRORS IN THE SERVICES. IF YOU RELY ON THE SERVICES, YOU DO SO ENTIRELY AT YOUR OWN RISK.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL DMLS (OR ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, SERVICE PROVIDERS, REPRESENTATIVES AND AGENTS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR USE OF THE SERVICES, INCLUDING ANY (1) ERRORS, OMISSIONS, INTERRUPTIONS, OR INACCURACIES IN ANY SERVICES, (2) FAILURE TO STORE OR PRESERVE INFORMATION IN CONNECTION WITH YOUR ADDRESS BOOK, OR (3) DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST REVENUES OR PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA) ARISING OUT OF YOUR USE OR MISUSE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY, WHETHER TORT (INCLUDING NEGLIGENCE), CONTRACT, OR ANY OTHER LEGAL OR EQUITABLE THEORY AND EVEN IF WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY FOR THESE KINDS OF DAMAGES, SO THESE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. YOU RELEASE DMLS (AND ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, SERVICE PROVIDERS, REPRESENTATIVES AND AGENTS) FROM ANY CLAIM RELATING TO YOUR USE OF THE SERVICES. YOU AGREE THAT THE LIABILITY OF DMLS (AND ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, SERVICE PROVIDERS, REPRESENTATIVES, AND AGENTS), IF ANY, ARISING OUT OF ANY LEGAL CLAIM ARISING FROM YOUR USE OF THE SERVICES WILL NOT EXCEED $1,000.00 IN THE AGGREGATE.
No Advice
Nothing on the Services constitutes, or is meant to constitute, advice, recommendations, or endorsement of any kind. If you require advice in relation to any real estate, legal, or financial matter, you should consult an appropriate professional.
- Indemnification
You agree to defend, indemnify and hold harmless DMLS (and its members, directors, officers, employees, service providers, representatives, and agents) against all liabilities, losses, damages, and costs (including reasonable attorneys' fees) that they may incur based on claims arising out of (1) your use of the Services or products obtained through it, or (2) a violation of these Terms. DMLS reserves the right, at our own expense, to assume the exclusive defense and control of any matter for which we are entitled to indemnification. You agree to provide us with whatever cooperation we reasonably request.
Changes to Services; Termination
- DMLS reserves the right to make changes or improvements to the Services at any time for any reason without notice.
- DMLS reserves the right to terminate the Services or access to the Services at any time for any reason with or without notice to you. Paragraphs 3, 4, and 9 through 13, and of these Terms (along with any other provision that by its terms contemplates survival) survive any termination of these Terms.
General
- These Terms are the complete agreement between you and DMLS regarding your use of the Services (in addition to the Subscriber Agreement, if applicable) and are governed by the laws of the State of North Carolina. You irrevocably agree to bring any claim or dispute relating to your use of the Services or these Terms exclusively in the state and federal courts located in the State of North Carolina, to submit to the exclusive jurisdiction of those courts, and to waive any jurisdictional, venue, inconvenient forum, or other objections to those courts.
- If a court of competent jurisdiction determines that any provision of these Terms is unenforceable for any reason, then that provision will be deleted and the remaining provisions will be enforceable to the fullest extent permitted by law. In the event a court having jurisdiction over the parties holds any provision of this Agreement invalid or unenforceable, the parties shall negotiate in good faith to replace the invalid or unenforceable provision, if possible, with a valid provision that most closely approximates the intent and economic effect of the invalid provision.
- You agree that we may provide you with notices by posting on our site, by e-mail, or by regular mail. If we do not exercise or enforce a right or remedy in these Terms or otherwise available, you agree we have not waived such right or remedy.
- The term "including" in these Terms means "including, but not limited to."
- These Terms (in addition to the Subscriber Agreement, if applicable) contain the full and complete understanding between DMLS and you regarding your use of the Services and supersedes all prior representations and understandings, whether oral or written, relating to the same subject matter.
