Compensation in the MLS Follow
Communicating the presence or amount of an offer of commission, compensation, brokerage fees, or related language in the MLS is strictly prohibited.
This applies to:
- All MLS front-end systems
- DMLS Listing Manager
- ShowingTime
- HomeSpotter
- Any other MLS-provided service
Violation Consequences:
- Category III Violation
- Non-correctable violation - minimum $500 fine
- Fine cannot be waived
Best Practices to Stay in Compliance
- Avoid suggestive verbiage in any of the Remarks fields that may imply the presence of compensation, such as: “Buyer’s Agents Welcome” , “We have 220 forms”, “Sellers are willing to cooperate”
- Do Not Upload documents like the Listing Agreements or form 220 as they contain compensation details. MLS does not require these to be uploaded. Other examples include:
- Listing Agreement Ext.
- Brochure/Flyers/Photos with Compensation
- Lease Agreements
- Avoid Compensation Emails via ShowingTime
Do not send any messages through ShowingTime that reference or imply compensation.
- Check Linked Websites for Compliance
Any landing pages linked in the remarks must not contain language that states or implies compensation.
